I made a house payment at my mortgage company’s online site. I have to separate banking accts. I usually pay with acct. "A", however since money was low in that acct., I used acct. "B" to make the payment. On the mortgage company’s website it is clearly marked that this is a "one time payment" and each time you pay at their site you must enter your banking routing number and checking acct. #.
Several days later upon checking acct. "A’s" balance online, I noticed that my mortgage company took their payment out of the wrong acct. It cause a major overdraft, and other bills and previous charges are bouncing. I immediately called my bank that has acct "A" and explained the situation. They filed a claim to take back the funds from the mortgage company. They said it could NOT be deamed fraud at this time because my husband’s name is listed on the transaction. It did not matter to them, that my husband never authorized this transaction from acct. "A". In the mean time it can take 2 to 10 business days before this money is redepositted. I will not be charged any penalties from my bank, but it is still unclear to me if my other "bills and charges" if those companies will drop their penalities and not place this on my husband and my credit rating.
I also called my mortgage company. They said that normally they can void transactions, but in this case since they show no error on their side, they will not look into the situation until I prove my case. I have a printed receipt from their website showing the amount , date I made the transaction, and bank "B’s" acct. and name CLEARLY listed. I faxed them this, and they told me to check back in a couple of hours. When I called back, I spoke with a manager, who told me that this case does not make any sense too him. He said he has yet to receive the fax but he will look for it, but no where in there system does my transaction appear nor acct "B". I explained to him that I needed my money reinstated by midnite that day, so that no other checks/debits bounce, he said he would do his best, but could not guarantee me , he could get results that fast. He said he can’t explain what has happened here, it could even be an "inside theft" but he was not certain. He promised to call or email me, later that day, just to keep me updated on where he was in the investigation. No call, no email. I called the next day, I asked to speak with the same manager again, but was transferred to another. This man said that faxes take 24 to process through their system and that there WAS no way they could get it any faster. I stressed the urgency of the matter with him, he was not helpful, nor caring as the first manager. I asked him repeatedly if I could talk to the last manager, he said that it would get me no where, he was telling me "the truth". He told me that once the resolution dept. views my fax and claim, they will decide the outcome. I asked him if he would at least call or email me later today, with anything he might have heard, he said he would, but I knew he wouldn’t and he didn’t.
I will continue to call the mortgage company until this is resolved. I don’t care what my bank says, my mortgage company fraudulantly acted when they withdrew money from the wrong acct. In fact, when you pay at my mortgage company’s site…it clearly states that monies will be taken from the acct. you authorize within 24-48 hours. This fraudulant withdraw was done 6 days after my intial transaction.
Please help me, what is my recourse here. Money is very tight these days, and I am desparate for answers.
My mortgage is not in collections. It is current.
I do have the print out of the transaction…thank God…but even with it, my mort.co. is giving me the run around, saying that there is no way they could have made this error, it must be mine. I have faxed them 3 times with my proof etc., an each supervisor claims that my Fax is not in the system, talk about frustrating, if it isn’t resolved soon, I am considering legal action, because I don’t know what else too do!
